The Israel Anti-Drug Authority (“IADA”) and the European Monitoring Centre for Drugs and Drug Addiction (“EMCDDA”) together referred to as “the Organisations”, share the understanding that it is in their common interest to develop their technical cooperation as described in this Memorandum.

1. Rationale
1 . הנמקה
This co-operation is based on the Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the State of Israel, of the other part (signed in Brussels on 20 November 1995), and the 2005 EU-Israel Action Plan, which establishes the general framework of bilateral relations, foresees the mutual exchange of experience and enhancement of mutual co-operation between authorities competent for dealing with the different aspects of the drug phenomena.
שיתוף פעולה זה מבוסס על ההסכם האירופי ים -
תיכוני המכונן שותפות בין הקהילות האירופיות
והמדינות החברות ב הן, מצד אחד, ומדינ ת ישראל,
מהצד האחר ) נחתם בבריסל ביום 20 נובמבר 1995 ,)
ותכנית הפעולה א"א ישראל - 2005 , הקובעת את
המסגרת הכללית של ה יחסים הדו צדדיים, החוזה -
חילופים הדדיים של ניסיון ו העצמה של שיתוף הפעולה
ההדדי בין הרשויות המוסמכות לטיפול בהיבטים
השונים של תופעת הסמים.
The 2 May 2012 EU-Israel Association Committee drew a list of bilateral cooperation topics to be implemented in the short term within the current Action Plan, which was endorsed by the EU-Israel Association Council on 24 July 2012. This list explicitly refers to the EMCDDA in its capacity of the EU body responsible for monitoring and reporting on key aspects concerning drugs and drug addiction and their consequences, including with a view to cooperation with the Israeli National Drug Observatory.

רשימה של נושאים לשיתוף פעולה דו צדדי ש יוטמעו -
בטווח הקצר במסגרת תכנית הפעולה הנוכחית,
שאושרה על ידי מועצת ההתאגדות של האיחוד
האירופי וישראל ביום 24 ביולי 2012 . רשימה זו
מתייחסת במפורש ל - EMCDDA במעמדו כג וף של
הא"א האחראי לניטור ולדיווח על היבטים מרכזיים
בנוגע לסמים ולהתמכרות לסמים ולהשלכותיהם, כולל
במגמה לשיתוף פעולה עם מרכז הניטור הישראלי
לסמים ואלכוהול.
The two Organisations are guided by the principles and aims of existing multilateral international agreements on drug control. They express their wish to develop a framework of mutual cooperation in the

field of information on prevention and responses to illicit drugs use, in line with international and EU standards. They recognise that information on the drugs phenomenon is an essential and indispensable instrument for the drafting and implementation of drug policies and for the assessment of the impact of actions to reduce the problems originating from drug use and trafficking.

The Organisations also express their interest in sharing experience and knowledge of methodologies aiming to develop and harmonise indicators of the drug situation, as well as develop an information system.
כן מביעים הארגונים את העניין שלהם בשיתוף ניסיון
וידע במתודולוגיות במגמה לפתח בהתאמה מדדים של
מצב הסמים, כמו גם פיתוח של מערכת מידע.
Note is taken of the fact that IADA is the competent authority to centralise the analysis of non-confidential data on illicit drug consumption and trafficking in Israel.
נציין את העובדה כי - IADA הינה הרשות המוסמכת
לריכוז ניתוח של נתונים שאינם חסויים על צריכה
וסחר בסמים בלת י חוקיים בישראל.
2. Objective
2 . יעד
The objective of this memorandum is to set up cooperation relations between the Organisations in order to facilitate the collection, processing and dissemination of information on drugs, to further develop common methods for monitoring illicit drug consumption and related problems as well as drug supply, including drug trafficking, with the aim of elaborating and improving comparable indicators for drug situation and response monitoring and evaluation systems.
יעדו של מזכר זה היא ל הקים יחסי שיתוף פעולה בין
הארגונים על מנת לקדם את האיסוף, העיבוד וההפצה
של מידע על סמים, להוסיף ולפתח שיטות משותפות
לניטור צריכת סמים בלתי חוקיים ובעיות קשורות, וכן
אספקת סמים, כולל סחר בסמים, במגמה להרחיב
ולשפר מדדים בני השוואה ל גבי המצב וההתמודדות עם
בעיית הסמים עבור מערכות הניטור וההערכה.
3. Responsibilities
3 . אחריות
Within their respective legal frameworks, the Organisations will invite each other to attend meetings convened under their respective auspices on occasions when they consider subjects of mutual interest will be discussed.

In particular, the IADA will use its best efforts to elaborate and present to the EMCDDA an annual report and analytical notes on the drug situation in Israel.

In particular, the EMCDDA will endeavour to facilitate training and the exchange of experts and results of scientific research on the problems of illicit drug trafficking and on monitoring the drug situation as well as on other issues of mutual interest.
במיוחד, EMCDDA תפעל לקדם הכשרה וחילופי
מומחים וממצאי מחקר ים מדעיים על בעיות הסחר
בסמים בלתי חוקיים ועל ניטור מצב הסמים כמו גם על
נושאים אחרים שיש בהם עניין משותף.
The Organisations will establish a regular exchange of information on new types of drugs and psychotropic substances that appear on the illegal drug market, the technologies of their production and their use.
הארגונים יבנו תהליך קבוע של חילופי מידע על סוגים
חדשים של סמים וחומרים פסיכוטרופיים המופיעים
בשוק הסמים הבלתי חוקי ים, הטכנולוגיות לייצורם
והשימוש בהם.
The activities on which specific co-operation has been foreseen will be set out in a joint work programme, which will be updated every three years.
הפעילויות שלגביהן נחזה שיתוף פעולה ספציפי יפורטו
בתכנית עבודה משותפת, שת עודכן מדי שלוש שנים.
The Organisations will not divulge classified information or documents received from the other Organisation without the preliminary consent of the Organisation that provided the information.
הארגונים לא ימסר ו מידע מסווג או מסמכים
שהתקבלו מהארגון האחר ללא ההסכ מה מראש של
הארגון שמסר את המידע.
Each of the Organisations will designate a contact person for maintaining continued dialogue with a view to ensuring efficient and full application of the present Memorandum of Understanding.
כל אחד מהארגונים יקבע איש קשר שיהיה אחראי על
המשכיות הדו שיח במגמה להבט יח יישום יעיל ומלא -
של מזכר ההבנה הנוכחי.
4. Other Issues
4 . נושאים אחרים
The Organisations understand that the present Memorandum is not an international treaty and does not produce legally binding effects under international law. Practical application and implementation of its content will not be regarded as the fulfillment of international obligations by the European Union and its institutions.
הארגונים מבינים כי המזכר הנוכחי אינו אמנה
בינלאומית ואינו י וצר השפעות מחייבות מבחינה
משפטית לפי המשפט הבינלאומי. יישום מעשי והטמעה
של תוכנו לא ייחשבו כמילוי התחייבויות בינלאומיות
של האיחוד האירופי ומוסדותיו.
This Memorandum will become effective after signature by both Organisations, for an initial period of five (5) years. If, at the end of the initial five (5) years, neither of the Organisations notify the other of its intention to discontinue the application of the Memorandum, its validity will be renewed for a further five (5) years.
מזכר זה ייכנס לתוקפו ל אחר חתימה על ידי שני
הארגו נים, לתקופה ראשונית של חמש ) 5( שנים. אם,
בתום חמש ) 5 ( השנים הראשונות, אף אחד מהארגונים
לא יודיע לארגון האחר על כוונת ו להפסיק את החלת
המזכר, תוקפ ו יתחדש לחמש ) 5( שנים נוספות.
The Memorandum will cease to be effective six (6) months after the date of receiving a notification to that regard.
המזכר יחדל להיות בתוקף שישה ) 6( חודשים לאחר
תאריך קבלת הודעה לעניין זה.
The Organisations have decided that all possible disputes concerning the interpretation and application of this Memorandum will be settled by means of negotiations and consultations between the Organisations themselves.
הארגונים החליטו כי כל מחלוקת אפשרית בנוגע
לפרשנותו ול יישו מו של מזכר זה ייושב בדרך של משא
ומתן והתייעצויות בין הארגונים עצמם.
This Memorandum of Understanding is produced in two original copies in English and Hebrew languages, both being authentic.
מזכר הבנות זה הופק בשני עותקים מקוריים בשפות
אנגלית ועברית, ושניהם מהימנים.
In case of divergence in interpretation of the provisions of the present Memorandum, the English text shall be of reference.
במקרה של הבדלים בפרשנות הוראותיו של המזכר
הנוכחי, הנוסח האנגלי יהיה הנוסח הקובע.
