The European Centre for Disease Prevention and Control (hereinafter referred to as ECDC) and 
the European Monitoring Centre for Drugs and Drug Addiction (hereinafter referred to as the EMCDDA), 

Having regard to 

  • Regulation (EU) 2017/2101, which amends Regulation (EU) 1920/2006, in particular Article 1 (3) thereof, by inserting Article 5b on "Initial report" referring to the obligation incumbent on the EMCDDA to establish working arrangements, notably with ECDC, for the exchange of available information and data on new psychoactive substances; 
  • The Cooperation Agreement concluded between ECDC and the EMCDDA on 29 June 2007, in particular Article 7 thereof, 

Whereas,

  • An amendment of the existing Cooperation Agreement is deemed by the Parties as the most suitable way to implement the obligations introduced by Regulation (EU) 2017/2101, 
  • It is the common interest of the Agencies to enhance further cooperation, while avoiding duplication of efforts and overlaps in their respective activities, and ensuring the best use of available resources 

HAVE AGREED AS FOLLOWS: 

Article 1 

Article 4, is supplemented by the following paragraph, 
"3. The Parties shall exchange information and data on new psychoactive substances in accordance with their respective mandates and the requirements of Article 5b of Regulation (EC) No. 1920/2006 as amended: 

(a)    ECDC shall, upon formal request from the EMCDDA, provide the EMCDDA with the information and data at its disposal on new psychoactive substances, their use and associated health and social problems. ECDC shall aim at providing the information and data, where available, no later than three weeks counting from the day the receipt of the request from the EMCDDA. "
(b)    Each Agency/Party shall designate one or more staff members for the maintenance of close, direct and continuing contacts with a view to ensuring the implementation of the provisions of the present Working Arrangement.

Article 5, paragraph 1 shall be replaced as follows, 
"1. Each Party shall ensure that information received on the basis of this agreement will be subject to its confidentiality and security standards for the processing of information in accordance with applicable EU legal acts governing the processing and release of information, data and documents" 

Article 2 

All the other provisions of the cooperation agreement shall remain unchanged. 

Article 3 

The present amendment shall enter into force on the date on which it is signed by the last party.
